An Ordinance to Regulate Traffic, Vehicular Noise, Parking, Pedestrians, Littering and Defacing of Property on Property of the Board of Trustees of Michigan Technological University
WHEREAS, Article VIII, Section 6 of the Michigan Constitution of 1963 provides that the Board of Control of Michigan Technological University shall be a body corporate and vests therein the general supervision of said University; and
WHEREAS, Section 2 of Public Act 70 of 1885 as amended (Michigan Statutes Annotated, Section 15. 1312), provides that the government of the University is vested in said Board of Control; and
WHEREAS, Section 13 of Public Act 70 of 1885 as amended (Michigan Statutes Annotated, Section 15.1323), provides that the Board of Control shall have power to enact ordinances; and
WHEREAS, Section 1 of Public Act 80 of 1905 as amended (Michigan Statutes Annotated, Section 4.201), provides that the said Board of Control shall have authority to make and prescribe rules and regulations for the care, preservation, and protection of buildings and property dedicated and appropriated to public use, over which said Board of Control has jurisdiction or power of control and conduct of those coming upon the property thereof, which may be necessary for the maintenance of good order and the protection of said state property, and further provides that said Board of Control shall have authority to enforce such rules and regulations; and
WHEREAS, Public Act 372 of 1972 (Michigan Statutes Annotated, Section 15.1120(53)) authorizes that said Board of Control may establish a parking violations bureau to accept pleas of guilty and to collect and retain fines and costs; and
WHEREAS, Section 1 of Public Act 291 of 1967 (Michigan Statutes Annotated, Section 15.1120(51)) authorizes said Board of Control to enact parking, traffic and pedestrian ordinances for the government and control of its campuses, and to provide fines for violations of such ordinances; and
WHEREAS, pursuant to the above-designated authority, and in discharge of the responsibility imposed thereby, the Board of Control of Michigan Technological University deems it necessary to adopt ordinances, rules and regulations for the care, preservation, protection and government of University property; for the conduct of persons coming upon said property; for the regulation of the driving and parking of motor vehicles upon said property; for the removal and impoundment of motor vehicles abandoned thereon; for the maintenance of good order; for the promotion of public health, safety, and general welfare in and upon said property.
WHEREAS, Public Act 515 of 1978 amends Public Act 291 of 1967 and Public Act 372 of
1972 regarding the enacting of parking, traffic and pedestrian ordinances, the enforcement
of such ordinances, and the disposition of the fines collected; and
WHEREAS, the Board of Control, Michigan Technological University has previously passed
Ordinance No. 1 and amendments thereto;
NOW, THEREFORE, the Board of Control of Michigan Technological University hereby ordains as follows:
